Distance Sales Contract

Arda Civelek (“www.ardacivelek.com”) only sells products offered through this remote sales channel to end consumers for retail purposes. Any orders that are clearly not retail and any fraudulent orders will be deemed invalid by www.ardacivelek.com. The consumer hereby declares and undertakes that the purchase made through this channel is not for professional, commercial, or business-related purposes.

Article 2 – Subject

The subject of this agreement is the sale and delivery of products that the Buyer orders electronically via the website www.ardacivelek.com, in accordance with the provisions of the Law on Consumer Protection No. 6502 and related regulations. It defines the rights and obligations of the parties.

Article 3 – Product Details

The type, quantity, brand/model, color, and total sale price (including VAT) of the product(s) are specified in the order form and invoice.

3.1 – Payment Terms:

  • The payment information is presented during the checkout process.

  • Banks may offer promotional campaigns such as additional installments or deferred payments.

  • The bank may distribute installment payments unevenly. For detailed plans, please refer to your bank.

3.2 – Delivery:

  • Delivery will be made via courier to the address provided by the Buyer.

  • Even if the Buyer is not present at the delivery address, the Seller shall be deemed to have fulfilled their obligation.

  • Any delay or costs arising from the Buyer’s failure to receive the product will be borne by the Buyer.

Article 4 – General Provisions

  • The Buyer acknowledges that they have read and accepted the basic features, price, and delivery information of the product.

  • The product will be delivered within 30 days at the latest unless otherwise stated.

  • If the product is delivered to someone other than the Buyer, the Seller is not responsible if that person refuses delivery.

  • The Seller is responsible for delivering the product complete, in good condition, and with necessary documents (e.g., warranty, manual).

  • The Seller is not liable for delivery delays due to courier company issues.

  • If payment is not made, the Seller has no obligation to deliver the product.

  • If the payment is reversed due to unauthorized use of the Buyer's card, the product must be returned to the Seller within 3 days. Shipping costs will be covered by the Buyer.

Article 5 – Right of Withdrawal

The Buyer may withdraw from the contract within 14 days of receiving the product without any justification or penalty. Notification must be made via fax, e-mail, or phone. The product must be returned unused, in its original condition, with all packaging and accessories. The shipping cost for the return will be borne by the Seller.

Article 6 – Products Exempt from Withdrawal

The right of withdrawal does not apply to:

  • Opened or used products

  • Products not suitable for return due to hygiene or health reasons, including:

    • Underwear

    • Personal care products

    • Cosmetics

Article 7 – Default Provisions

If either party fails to fulfill their obligations, the provisions of the Turkish Code of Obligations regarding default shall apply. The non-complying party will be granted 7 days to remedy the situation. If obligations are still unmet, the aggrieved party may terminate the contract and request a refund or delivery.

Article 8 – Competent Court

In disputes arising from this contract, Consumer Arbitration Committees and Consumer Courts at the location of the Buyer or Seller are authorized, up to the monetary limits set by the Ministry of Trade.
